History
Although there are numerous public right-of-ways leading to the water in Bonner County, this is one of only a few that is regularly used by the public. Because parking is extremely limited, and the public may thus be tempted to encroach on adjacent private land, use of public right-of-ways is best done in low-impact ways. Historically, within larger Bonner County, the use of public right-of-ways for public recreation has often been contentious due to objecting neighbors.
However, if the public does not use these right-of-ways, developers have argued that they should not be public. In 2022, another right-of-way that dead-ended into the water was vacated by Bonner County and given to private developers, because the developers successfully argued that the right-of-way was not used by the public.
